Conditions of sale

The owner of the YARNPROF online shop (hereinafter referred to as the Online Shop) is MPP Grupp OÜ (registration code 14457217), located at Tooma vkt 8, Laulasmaa village, Lääne-Harju parish, Harju County, Harju County 76702.

  • The terms and conditions of sale are valid between the buyer (hereinafter referred to as the Buyer) and the company MPP Grupp OÜ for the purchase of goods.
  • In addition to these terms and conditions, legal relations arising from the purchase of products from the Online Shop are regulated by the Law of Obligations Act (hereinafter LOA), the Consumer Protection Act (hereinafter CPA) and other legislation in force in the Republic of Estonia.
  • The online shop reserves the right to make changes to the terms and conditions of sale and the prices of products and services. These changes will be reflected on www.yarnprof.ee
  • yarnprof.eu is an online shop only. There is no physical shop.

Product and price information

  • MPP Grupp OÜ is a taxable person for VAT purposes (KMKR EE102416631). All prices on the Online Shop include VAT.
  • The prices of the products sold on the online shop are indicated in euros (EUR) per unit of the products. The unit is indicated in the product description – piece, pair, set.
  • The price is subject to a delivery charge according to the delivery method and location chosen by the Buyer. The delivery method is chosen and the delivery fee is calculated at the checkout. When ordering from a parcel machine, we will post the parcel within 3-7 working days after payment.
  • Information about the goods is provided on the Online Shop directly next to the goods.
  • Product descriptions on the online shop are based on the information provided by the manufacturer of the product.
  • Product images displayed in the online shop may differ from the actual product – the actual colour of the products may differ slightly from the images, as the display of colours depends on the settings of each display.
  • If the order is placed before the conditions of sale or prices are amended, the legal relations between the Buyer and the Online Shop shall be governed by the conditions in force at the time the order was placed.
  • The online shop has the right to withdraw from the sale and refund the amount of the order or to demand the return of the product from the buyer if the price of the product is significantly below the market price due to a mistake.

Placing an order and payment

  • To order, you must add the products you want to your shopping cart.
  • To place an order, you must fill in the required fields with the correct information and select the appropriate delivery method. The cost of the purchase is then displayed on the screen, which can be paid via bank transfer.
  • Payments are intermediated by Montonio Finance UAB. Payment takes place outside the Online Shop in a secure environment – in the case of payment by bank transfer in the secure environment of the respective bank and in the case of payment by credit card in the secure centre of Montonio Finance UAB. The seller does not have access to the customer’s bank and credit card details. The contract shall enter into force from the date of receipt of the amount due to the current account of the Online Shop.
  • The owner of the online shop is the controller of personal data and transfers the personal data necessary for the execution of payments to the processor Montonio Finance UAB.
  • The order is deemed to be confirmed/submitted to the Online Shop when the Buyer has received an electronic notification with the Invoice Order Confirmation to his/her e-mail address.
  • The order is deemed to have been successfully completed and to be executed when the amount due is credited to the account of the Online Shop.
  • All orders over the payment deadline will be cancelled and the products will be released from the reservation.
  • If the goods ordered cannot be delivered due to expiry of the goods, defects or any other reason, the Buyer will be informed as soon as possible. The money paid will be refunded (including the cost of delivery) without delay, but no later than 14 days after the notice is sent.
  • The online shop has the right to withdraw from the sale and refund the amount of the order or to demand the return of the product from the buyer if the price of the product is significantly below the market price due to a mistake.

Delivery to

  • The Buyer shall bear the costs of sending the goods according to the mode of transport chosen by the Buyer. The domestic delivery methods are: Itella parcel terminal – the cost of sending the parcel is €2.90, Omniva parcel terminal – the cost of sending the parcel is €3.35, Omniva courier to your home – the cost of sending the parcel is €6.30. Prices are subject to change according to changes in the supplier’s price list. Orders over 79 euros to parcel machines (excluding postage and discounts) are paid by the seller MPP Grupp OÜ.
  • Shipments within Estonia usually arrive at the destination specified by the Buyer within 3-7 working days from the entry into force of the sales contract. Outside Estonia, the delivery time depends on the transport companies abroad.
  • In exceptional cases, you have the right to have the goods delivered within up to 45 calendar days (for example, for products that have been reordered).
  • Delivery abroad is subject to prior written agreement (by e-mail). The costs of delivery abroad shall be borne by the Buyer in accordance with the price list of the service provider. The online shop will invoice the Buyer for the use of the service.

Right of withdrawal, return and exchange of products

  • After receipt of the order, the Buyer has the right to withdraw from the contract concluded in the Online Shop within 14 days [depending on the products, the Buyer may not have the right to withdraw, the relevant products and services must be listed in such a case and must meet the conditions listed in § 53(4) of the Law of Obligations Act]. The withdrawal period starts from the day on which the Buyer has taken possession of the product.
  • The online shop has the right to withdraw from the sale and refund the amount of the order or to require the buyer to return the product if the price of the product is significantly below the market price due to a mistake.
  • In order to return or exchange the goods, the Buyer must submit a cancellation/exchange application or a free-form application (e-mail) indicating the order invoice number and the defect of the product(s). Send the declaration to info@yarnprof.ee within 14 days of receipt of the goods.
  • In order to exercise the 14-day right of withdrawal, the goods ordered may not be used in any other way than is necessary to ascertain the nature, characteristics and functioning of the goods, in the same way as is allowed for testing the goods in a physical shop.
  • If the goods have been used for purposes other than what is necessary to ascertain the nature, characteristics and functioning of the goods, or if the goods show signs of use or wear, the Online Shop has the right to reduce the refundable fee in accordance with the reduction in the value of the goods.
  • The costs of returning the goods will be borne by the Online shop, if the reason for returning the goods is that the goods to be returned do not correspond to the ordered goods (e.g. wrong or defective goods).
  • The buyer must return the goods within 14 days of the date of the application or provide proof that he has handed them over to the carrier within that period.
  • Upon receipt of the returned goods, the Online Shop shall immediately refund to the Buyer all payments received from the Buyer under the contract.
  • The online shop may refuse to make refunds until it has received the goods that are the subject of the contract or until the Buyer has provided proof that it has returned the goods, whichever is the earlier. If the Buyer has expressly chosen a delivery method other than the cheapest delivery method offered by the Online Shop, the Online Shop does not have to reimburse the consumer for the cost that exceeds the cost of the usual delivery method.

Right to lodge a complaint

  • The online shop is liable for the non-conformity or defect of the goods sold to the Buyer, which already existed at the moment of delivery and which will become apparent within a period of up to two years from the delivery of the goods to the Buyer. Within the first six months of the delivery of the goods to the purchaser, the defect is presumed to have existed at the time of delivery. It is the responsibility of the Online Shop to rebut this presumption.
  • In the event of a defect, the buyer has the right to contact the online shop within two months at the latest by e-mail to info@yarnprof.ee.
  • The online shop is not liable for defects that occur after the delivery of the goods to the Buyer.
  • If the goods purchased from the Online Shop have defects for which the Online Shop is responsible, the Online Shop will repair or replace the defective goods.
  • If it is not possible to repair or replace the goods, the Online Shop will refund the Buyer all the fees related to the sales contract if the Buyer returns the goods to the Online Shop.
  • The online shop will respond to the complaint submitted by the Buyer in writing or in a format that can be reproduced in writing within 15 days.

Direct marketing and processing of personal data

  • The online shop uses the personal data entered by the Buyer (including name, telephone number, address, e-mail address, bank details) only for processing the order and sending the goods to the Buyer.
  • The online shop transfers personal data to transport companies in order to deliver goods.
  • The online shop sends newsletters and offers to the Buyer’s e-mail address only if the Buyer has expressed his/her wish to receive them by entering his/her e-mail address on the website and has indicated his/her wish to receive direct mail notifications.
  • The purchaser can opt-out of receiving offers and newsletters by email at any time by notifying us by email or by following the instructions in the email containing the offers.

Dispute resolution

  • If the Buyer has any complaints regarding the Online Shop, they should be sent in writing by e-mail to info@yarnprof.ee.
  • If the Buyer and the Online Shop are unable to resolve the dispute through an agreement, the Buyer can turn to the Consumer Disputes Committee. To find out about the conditions of the procedure and to submit an application, visit http://www.tarbijakaitseamet.ee/et/tarbijavaidluste-komisjon/esita-avaldus-komisjonile. The Consumer Disputes Committee is competent to settle disputes arising out of a contract concluded between the buyer and the Online Shop. There is no charge for the Commission to examine the buyer’s complaint. The buyer can turn to the European Union’s consumer dispute resolution platform.
